Why Californians Choose a Living Trust

Skip probate court

In California, assets left only by a will usually go through probate, a public court process that often takes a year or more. Statutory fees are set by law as a percentage of the estate: on a $500,000 estate, attorney and executor fees alone can total about $26,000.

Plan for incapacity

If you become unable to manage your affairs, the person you choose steps in right away, without a court conservatorship. Your powers of attorney and health care directive cover the rest.

Protect your children

Name guardians for minor children, decide when and how beneficiaries receive their inheritance, and keep your family’s affairs private.

Common Questions

Do I need a trust if I already have a will?

Usually, yes, if you own a home or other significant assets in California. A will alone generally has to go through probate, while assets held in a funded living trust pass to your beneficiaries without court involvement.

How long does it take?

Most plans are ready to sign within a few weeks of the design meeting, depending on how quickly you review the drafts.

Can we do everything remotely?

Yes. Meetings and document reviews happen by Zoom or phone anywhere in California. Some documents must be signed before a notary, and we’ll coordinate that at one of our offices or with a notary near you.

What does “funding” the trust mean?

A trust only avoids probate for assets titled in its name. We prepare the deed for your home and give you clear instructions for bank, brokerage and other accounts, so nothing is left out.

Can I change my trust later?

Yes. A revocable living trust can be amended or restated as your life changes, such as after a marriage, a new child or a move.
